Terms of service
Terms of Service
These Terms of Service apply to purchases made from The Newport Curiosity Shop through our website.
By placing an order with us, you agree to these terms.
Nothing in these Terms of Service excludes, restricts or affects any statutory rights you have under UK consumer law.
1. About Us
This website is operated by:
The Newport Curiosity Shop
Email: raybouldsvintage@outlook.com
Address: 64 George Street, Newport, NP20 2AA
2. Our Products
We sell a mixture of new, vintage, antique, pre-owned, collectible and spiritually themed goods.
Please read the full product description, measurements and condition information and examine all available photographs before placing an order.
New Products
Items described as new are supplied as new goods and may be sourced from manufacturers, wholesalers or distributors.
Packaging, labels and presentation may occasionally differ slightly from website photographs where a manufacturer or supplier has updated them, provided that this does not materially alter the product supplied.
Vintage, Antique and Pre-Owned Products
Vintage, antique and pre-owned goods should not be expected to be in new condition unless expressly stated.
They may have age-related characteristics including, but not limited to:
- scratches;
- marks;
- fading;
- patina;
- tarnishing;
- crazing;
- chips;
- dents;
- signs of previous use;
- historic repairs;
- manufacturing irregularities; and
- general wear consistent with age.
We make reasonable efforts to photograph and describe significant condition issues that we are aware of.
Where a particular mark, defect, repair, imperfection or other characteristic has been clearly disclosed in the description or photographs before purchase, this forms part of the condition in which the item is sold.
Nothing in this section affects your statutory rights where goods are faulty or materially not as described.
3. Measurements and Suitability
Measurements and dimensions stated on product listings are approximate unless expressly stated otherwise.
Customers are responsible for checking measurements, dimensions and other relevant product information before purchasing.
This is particularly important for items where size may affect suitability, including furniture, decorative objects, clothing, walking sticks, storage items and other vintage goods.
A customer’s failure to check clearly stated measurements does not by itself mean that an item has been incorrectly described.
4. Photographs and Colour
We make reasonable efforts to display products accurately.
Colours, finishes and textures may appear slightly different depending on lighting, photography, screen settings and the device used to view the website.
Natural, handmade, vintage and mineral products may also vary in colour, shape, pattern, texture or finish.
5. Spiritual, Witchcraft and Metaphysical Products
Some products sold by The Newport Curiosity Shop may be associated with spirituality, witchcraft, folklore, ritual, meditation, symbolism or traditional beliefs.
Descriptions referring to the spiritual or metaphysical properties of crystals, charms, herbs, candles, incense, oils or similar products are provided for informational, cultural or traditional purposes.
We do not guarantee that any such product will produce a particular spiritual, emotional, medical, financial, romantic, legal or other outcome.
Products and information provided on our website are not a substitute for medical, psychological, legal, financial or other professional advice.
6. Product Safety and Proper Use
Customers should follow all instructions, warnings and safety information provided with a product.
Products including candles, incense, burners, oils and similar items must be used responsibly and only for their intended purpose.
Where appropriate, products should be kept away from children, pets, heat sources and flammable materials.
We are not responsible for loss or damage resulting from use that is contrary to the manufacturer’s instructions, supplied safety information or the product’s reasonably intended use, except where liability cannot lawfully be excluded.
7. Availability
Many vintage, antique and collectible products are one-of-a-kind.
All orders are subject to availability.
Occasionally an item may become unavailable after an order has been submitted, including where a unique item has been sold through another sales channel before our stock records have updated.
If this occurs, we may cancel the affected item or order and refund any payment received for it.
8. Prices
Prices are those displayed on our website at the time an order is placed.
Delivery charges and any other applicable charges will be displayed before you complete your purchase.
We may change prices at any time, but changes will not affect orders that have already been accepted.
If an obvious pricing or listing error has occurred, we reserve the right to cancel the affected order and refund any payment received.
9. Placing an Order
By submitting an order, you are offering to purchase the products contained in that order.
You are responsible for checking:
- the products selected;
- quantities;
- delivery address;
- email address;
- contact details; and
- delivery option
before completing checkout.
An automated order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it.
We may refuse or cancel an order where reasonably necessary, including where:
- an item is unavailable;
- there has been an obvious pricing or description error;
- payment cannot be authorised;
- we cannot reasonably deliver to the address provided; or
- we reasonably suspect fraudulent or unlawful activity.
If we cancel an order after payment has been taken, we will refund the amount due.
10. Delivery Address
Customers are responsible for providing an accurate and complete delivery address.
Please contact us immediately if you notice an error.
If an order has not yet been dispatched, we may be able to amend the delivery address.
Once an order has been dispatched, we cannot guarantee that an address can be changed.
Where a parcel is returned to us because an incorrect or incomplete address was supplied, we may require payment of a reasonable additional delivery charge before resending it, where permitted by law.
11. Delivery
Available delivery services and charges are displayed at checkout.
Delivery dates and transit times are estimates unless we expressly agree otherwise.
We are not responsible for delays caused by carriers or circumstances outside our reasonable control, although this does not affect any legal rights you have regarding delayed or undelivered goods.
Please contact us if an order has not arrived within the expected timeframe so that we can investigate.
12. Damaged Parcels
If an item arrives damaged, please contact us as soon as reasonably possible.
We may ask you to provide photographs of:
- the damaged item;
- the outer packaging;
- internal packaging; and
- the shipping label
to help us assess the issue and make any necessary claim with the carrier.
This does not affect your statutory rights.
Please retain damaged packaging until we confirm that it is no longer required.
13. Cancellations and Change-of-Mind Returns
For most goods purchased online, consumers have statutory cancellation rights.
Please refer to our Returns & Refund Policy for full details.
Where a change-of-mind return is permitted, you must tell us within the applicable statutory cancellation period.
Unless the item is faulty, not as described or otherwise legally required to be returned at our expense, you are responsible for the direct cost of returning the goods where we have informed you of this requirement.
14. Condition of Returned Goods
You may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning, in a similar way to how you would inspect goods in a shop.
Returned goods should be packaged appropriately to protect them during transit.
If your handling of an item goes beyond what is reasonably necessary to inspect it and this causes a reduction in its value, we may be entitled to make an appropriate deduction from the refund to the extent permitted by law.
15. Return Transit
Unless we have arranged the return ourselves or the law provides otherwise, you are responsible for ensuring that returned goods are packaged safely and sent back to the return address provided by us.
We recommend using an appropriately tracked and insured service for valuable or fragile items.
Your statutory rights are not affected.
16. Original Delivery Charges
Where you exercise a statutory right to cancel an eligible online purchase, we will refund the applicable standard outbound delivery charge as required by law.
If you selected a more expensive delivery option than the least expensive standard delivery service we offered, we are not required to refund the additional amount paid for that upgraded service.
17. Faulty or Incorrectly Described Goods
Goods supplied to consumers must meet the standards required by applicable consumer law.
If an item is faulty, unsafe, materially not as described or otherwise fails to meet your statutory rights, please contact us.
For vintage, antique and pre-owned goods, the item’s age, nature, price and any condition issues that were clearly disclosed before purchase may be relevant when assessing its condition.
Nothing in these terms limits any legal remedy available to you.
18. Attempts to Repair or Alter Goods
If you believe an item is faulty, please contact us before carrying out repairs, alterations or restoration where reasonably possible.
Unauthorised alterations or damage caused by an attempted repair may affect the remedies available where the problem was caused by that alteration or repair.
This does not remove any statutory rights relating to an original fault in the goods.
19. Personalised and Exempt Goods
Certain goods may be excluded from the usual statutory right to cancel, including some personalised or made-to-order products and certain sealed goods where applicable.
Where an exemption applies, this will be made clear where reasonably appropriate.
Your rights in relation to faulty or incorrectly described goods remain unaffected.
20. Payment
Payment must be made using one of the methods available at checkout.
We will not normally dispatch goods until payment has been successfully authorised.
21. Risk and Ownership
Responsibility for goods passes to you when they are delivered to you or to a person you have identified to receive them, subject to applicable consumer law.
Ownership passes to you once we have received payment in full.
22. Resale and Commercial Purchases
Unless expressly agreed otherwise, products sold through our website are intended primarily for personal consumer use.
If you are purchasing goods wholly or mainly for business, resale or commercial purposes, different rights may apply.
Please contact us before placing a substantial commercial or resale order.
23. Website Content and Intellectual Property
Unless otherwise stated, original photographs, written descriptions, graphics, logos and other original content created for The Newport Curiosity Shop belong to us or are used with permission.
You may not reproduce or commercially exploit our original website content without permission, except where allowed by law.
24. Website Availability
We aim to keep our website accurate and available but cannot guarantee that it will always operate without interruption or error.
We may update, modify or temporarily withdraw parts of the website where reasonably necessary.
25. Liability
Nothing in these terms excludes or restricts liability where it would be unlawful to do so.
In particular, nothing excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.
Subject to those limitations and your statutory consumer rights, we are not responsible for losses that were not reasonably foreseeable when the contract was entered into.
26. Personal Information
We process personal information in accordance with our Privacy Policy.
Please refer to that policy for information about how personal data is collected, used and protected.
27. Changes to These Terms
We may update these Terms of Service from time to time.
The terms applying to an order will be those in force when that order was placed.
28. Governing Law
These Terms of Service and purchases made through our website are governed by the applicable laws of the United Kingdom.
If you are a consumer, you retain any mandatory rights and protections that apply to you based on where you live.
